Employers Responsibility under POSH Act

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (“Act“) has become effective from 9th Dec. 2013.There are several statutory obligations under the law for employers and serious consequences for noncompliance.

The Act makes it mandatory for every employer including the following to:

  • Form an Internal Committee with more than 10 employees to deal with sexual harassment cases
  • Frame a sexual harassment policy
  • Regularly organize orientation programs for skill enhancement of members of Internal Committee
  • Organize workshops sensitizing all employees on the issues and implications of workplace sexual harassment at regular intervals
  • Provide a safe and harassment free environment for all employees and customers and visitors in the workplace the company
